TSE glossary explains differences between the electoral body and other public ministries, such as labor and the military
O Electoral Glossary, available on the TSE (Superior Electoral Court) website, presents the concept and functions of the MPE (Public Electoral Ministry). The entry informs that the Federal Constitution of 1988 defines the Public Ministry as a permanent institution, essential to the jurisdictional function of the State. This body is responsible for defending the legal order, the democratic regime and unavailable social and individual interests.
The glossary informs that, in the Constitution, the scope of the MP, however, did not include the Electoral MP among the distinct modalities of the Public Ministry. Therefore, in the current structure, there is no career Electoral Public Ministry and its own institutional framework, such as the Labor Public Ministry and the Military Public Ministry.
Article 37 of Complementary Law No. 75/93 deals generally with electoral functions, providing that the Federal Public Ministry will exercise its functions in cases within the competence of electoral courts and judges.
In relation to the role of the Electoral MP, the structure of the positions and distributed responsibilities are as follows:
- Electoral Attorney General: performs its functions in cases within the jurisdiction of the TSE;
- Regional electoral prosecutor: performs its functions in cases within the jurisdiction of the TRE;
- Electoral promoter: is the member of the local Public Prosecutor’s Office who acts before judges and electoral boards.
