The Proposal for Amendment to the Constitution (PEC) of the Precatório will enter the voting radar of the Constitution and Justice Commission (CCJ) of the Federal Senate this Wednesday (24). This will be the most important step of the PEC before going to the House’s plenary vote, since if the CCJ blocks the text, the project is rejected.
There are 27 senators registered in the CCJ and at least 14 of them need to declare “yes” votes for the proposal to be sent to the plenary. If approved by the Commission, the PEC should be voted on in the first round as early as next week.

One of the points of divergence around the text that was drafted in the Chamber of Deputies is the fiscal juggling that the Jair Bolsonaro government intends to do to break the Spending Ceiling and open a way to spend on the Budget. And to speed up the PEC in the Senate, the government is now working for a kind of slicing the text, in an attempt to approve parallel projects to support spending on social investments that impact the electoral campaign.
If the idea works out, the Senate can approve the text in its entirety as it arrived from the Chamber of Deputies, preventing the PEC from returning for analysis by the deputies, which would happen if any changes were made. This will enable the government to design the initial Brazil Aid and allocate the R$ 400 installments to families in extreme poverty.
In exchange for that, the government is already evaluating the possibility of leaving Auxílio Brasil as a permanent program, no longer with a deadline of December of next year, when the elections are closed. The leader of the government at Casa, Fernando Bezerra (MDB-PE), said today that the government is already working with this idea.
PEC in the hot seat and sliced
The PEC dos Precatórios should open a breather – or leak – of R$ 91.6 billion in the 2022 Budget, as the project foresees the rollover of the government’s judicial debts for the following years. With the trump card of making Brazil Aid feasible with installments of R$ 400 (a necessary proposal, but given the moment, with a visible electoral bias), Bolsonaro has already signaled that he will open the gate for public spending and try to promote a portion of increases in salaries of civil servants (another nod to potential voters).
In addition to making the R$ 400 a permanent policy, the senators want to create a way to protect the money that will be released with the PEC dos Precatórios. Therefore, they want to prevent this new fiscal margin from being used to increase the salary of civil servants, for example, and they want to allocate the resource exclusively to social policies.
In this scenario, in addition to Auxílio Brasil, programs such as salary bonuses, unemployment insurance and Social Security would benefit.
