The minister of STF (Federal Supreme Court) Cristiano Zanin will be the rapporteur of the action in which the federal government intends to overturn the payroll tax relief of 17 sectors of the economy and certain municipalities. Earlier, the action was filed by AGU (General Attorney's Office of the Union). The petition was signed by the president Luiz Inácio Lula da Silva (PT) and by the attorney general of the Union Jorge Messias this Wednesday (April 24, 2024).
Zanin's choice to report the case was made out of prevention. The minister has already acted as rapporteur in another action on the topic. There is no forecast for the minister's decision.
In AGU's understanding, the exemption was extended until 2027 by the National Congress, without establishing the financial impact of the tax exemption.
The action also challenges the decision of the president of the Senate, Rodrigo Pacheco (PSD-MG), which invalidated part of the MP (provisional measure) 1,202 of 2023, which deals with tax compensation. The MP overturned social security exemptions for small and medium-sized municipalities.
UNDERSTAND THE EXEMPTION IMPASSE
Haddad wanted to end the benefit through the provisional measure. After the negative reaction from congressmen and entities, the government took the issue to the Legislature in search of a partial victory – which was not done for the exemption.
The idea was to debate the issues in Congress through a bill so that there would be a middle ground between the economic team and congressmen on the subject. The proposal, however, did not advance and the government removed the urgency of the text sent for analysis by the Legislature.
The rapporteur of the project that was being processed in the Chamber, federal deputy Any Ortiz (Cidadania-RS), said that the new project on the topic would maintain the same format as the original – the exemption would remain until 2027 for the 17 sectors.
In January, the Treasury said that the impact on tax waivers of the payroll tax exemption on the 17 sectors would cost R$12.3 billion to the public coffers in 2024.
