The 20-year-old who invented a homophobic assault at the beginning of September in the Madrid neighborhood of Malasaña has been sentenced in a speedy trial to a fine of four euros a day for four months, that is, a total of 480 euros, for simulation of crime. The head of the Court of Instruction number 52 of Madrid has made this decision after hearing the statement of the accused, who has ratified, as he did before the police in his day, that he lied not to lose his partner, since the injuries suffered They were the consequence of a consensual sexual act.
From the beginning of the complaint, the agents did not obtain evidence to support the boy’s version. He claimed that eight hooded men had pushed him into the portal and that, after hitting and insulting him, they had engraved the word “fag” on his buttocks with a knife. After that, they fled the way they had come. But the police were not able to find any witnesses or images on security cameras that corroborated these facts. Shortly after, the alleged victim offered a second statement in which the lie collapsed and she had to explain the reality, overwhelmed by the facts: “It was consensual, at the home of another person with whom I had a sexual relationship.”
When this complaint came to light, hundreds of people rallied against homophobic attacks. They went out to the street despite the boy leaving a few hours later, because they wanted to make visible the real attacks that the LGTBI community does suffer. A concentration that was repeated this week in Puerta del Sol, in this case to protest against the threat posed by Vox for the repeal of the laws that protect this group in Madrid.
Precisely this Thursday, the National Police arrested a 24-year-old woman who denounced a homophobic attack in the Madrid neighborhood of Chueca last week, because she also ended up recognizing the agents who invented the attack. She has been released, but remains under investigation for the alleged simulation of a crime.
Despite these two cases, the data shows that hate crimes have rebounded in Spain, reaching figures higher than those before the pandemic. According to data from the Ministry of the Interior, in the first half of 2021 the police received 610 complaints, 9.3% more than in the same period of 2019, when there were no mobility restrictions
