Dino had a “leading role” in the case as Minister of Justice, says document; defense wants to transfer the case to Rio
The defense of the former head of the Civil Police of Rio de Janeiro, Rivaldo Barbosa, who is in pre-trial detention accused of involvement in the murder of councilwoman Marielle Franco, sent a letter to the STF (Supreme Federal Court) asking that Minister Flávio Dino declare himself impeached to participate in the trial. The document also requests that the case be transferred to the Rio de Janeiro Court.
According to lawyers, Dino cannot participate in the trial due to his direct involvement in the investigation of the case as Minister of Justice. The defense understands that the PF has the autonomy to open inquiries and investigate, but says that in the Marielle case the minister had “preponderant action” for the initiation of investigations. The lawyers also questioned the STF’s legal competence to judge Barbosa, as it does not have a privileged forum. As a result, the defense requests that the case be transferred to the Rio de Janeiro Court.
Rivaldo Barbosa was arrested on March 24, in Rio, along with Domingos Brazão, counselor at the Rio de Janeiro Court of Auditors, and his brother, federal deputy Chiquinho Brazão (no party-RJ). The Brazão brothers would have ordered Marielle’s death, and Barbosa – who was head of the Rio Civil Police at the time of the crime – would have given instructions for the execution and prevented the investigations from reaching those who ordered them.
On Monday (June 3), Barbosa denied in a statement to the PF (Federal Police) having any relationship with the brothers Chiquinho and Domingos Brazão, arrested on suspicion of being the masterminds behind the murder of Marielle Franco.
The former head of Rio’s Civil Police stated that “never had any personal, professional, political, religious or leisure relationship” with the Brazão brothers.
