André Figueiredo (PDT-CE) says there is no agreement with the parties; text establishes a rate of 6%, but exempts “Globoplay”
The Chamber postponed on Wednesday (May 14, 2024) the vote on the PL (bill) 8,889 from 2017known as “PL of streaming”. The rapporteur of the proposal, deputy André Figueiredo (PDT-CE), requested a postponement during the session as there was no agreement between the benches.
Another reason is that congressmen concentrated their efforts to approve the PLP (complementary bill) that postpones Rio Grande do Sul’s debt for 3 years, approved by 404 votes in favor and 2 against.
The report that would be voted on was presented by the rapporteur on Tuesday (May 13). Here’s the complete (PDF – 367 kB). The parties PL, União Brasil, Novo and PL obstructed the analysis. After asking for the vote to be postponed, the rapporteur stated that he is available to discuss the text with the benches.
“Since there are parties that are obstructing this project, I ask you to remove it from the agenda today, but I also ask those who truly want to do good for Parliament, not to shy away from discussing the content of the matter”said Figueiredo.
An excerpt from the opinion establishes that television services using internet applications and sharing audiovisual content, such as Netflix, for example, contribute up to 6% to Condecine (Contribution to the Development of the National Film Industry). The rate will be progressive and will be valid for gross revenue in the Brazilian market.
However, the section excludes from taxation the “concessionaires of sound and image broadcasting services or providers of Conditional Access Audiovisual Communication activities”. The platform Globoplayfrom Grupo Globo, would be exempt, as the company is a broadcasting concessionaire.
Especially the conservative wing in Casa Baixa was the one that most opposed the project. After the vote was postponed, the deputy Gustavo Gayer (PL-GO), celebrated the decision at the X (formerly Twitter). The congressman called the text “PL da Globo”.
“We did it, we changed the orientation of all the benches, they got scared and took the PL off the agenda”declared Gayer.
When announcing the postponement, the rapporteur said that the project “It’s not meant to benefit just one broadcaster” and placed “available to go to the PL bench and discuss the content” text.
“I am absolutely sure that there is no one here who wants to benefit international interests above national ones”he declared.
The President of the Chamber, Arthur Lira (PP-AL), agreed to 1 more day for the benches to debate the text. However, he reinforced in plenary that the proposal is “2 years in discussion” at the college of party leaders.
