Alexandre de Moraes' decision is ambiguous and suggests what conversation could have been in 2020; However, when the exchange of messages occurred, Ramagem was already an elected federal deputy and had been out of Abin for more than 6 months,
The decision of the STF (Supreme Federal Court) minister Alexandre de Moraes, who authorized search and seizure operations against the Rio de Janeiro councilor Carlos Bolsonaro, contains some ambiguities. The main piece used in the process – broadcast on the news throughout Monday (October 29, 2024) – is an image of messages exchanged between the federal deputy Alexandre Ramagem (PL-RJ) and Luciana Almeida, Carlos' former advisor.
In Moraes' decision, the message is reproduced shortly after the minister cited several alleged irregularities in October 2020. The date of the conversation between Ramagem and Luciana is “Tue, Oct 11”.
On the calendar during the mandate of Jair Bolsonaro (PL) there is only one “October 11th” on a Tuesday in 2022 (and not in 2020).
The inaccuracies in the decision were:
- On October 11, 2022, Ramagem was already a federal deputy elected by the State of Rio de Janeiro. The former Federal Police delegate had been away from Abin (Brazilian Intelligence Agency) for 6 months.
- In the order, the magistrate does not make it clear that the conversation is from 2022 or that Ramagem was no longer a member of Abin's staff.
- The message itself is not conclusive. The advisor says she needs “very helpful” and then gives the number of an investigation that, according to her, involved Jair Bolsonaro and 3 of his children. From the message, it is not clear what type of “help” he would be.
- In a first message, cut off from the record, Luciana says she wants “very successful” at “new step” of Ramagem’s life – a probable mention of his election as federal deputy. He thanks her and says that now the focus would be on “to elect” O “President Bolsonaro”.
The fact is that the Federal Police are investigating Abin's actions from 2019 to 2021. The justification for the operation that targeted Carlos Bolsonaro on Monday, according to Moraes, was the pointing out of a “new fact” by the PF: the existence of a “Political Center”.
“In addition to identifying the various conducts summarized above, the Federal Police, with the deepening of investigative measures, points out a new fact, related to the existence, in the aforementioned criminal organization, of the Political Nucleus, also responsible for the distortion of Abin and the First Mile tool” , said Moraes in his decision.
In the PF report itself, the corporation says that Luciana Almeida's “observation” about the investigations involving Bolsonaro and his 3 children “were not corroborated in relation to the IPLs referred to”. In other words, the investigation numbers provided, according to the PF, do not concern Bolsonaro and his children.
The corporation then says that in the period “there were ongoing investigations in the interests of the subjects” and that the source “didn’t get the correct procedure numbers”.
Even so, Alexandre de Moraes said that the evidence “indicate” that “criminal organization infiltrated in Abin” took advantage of “illegal methods” to chase opponents and to “inspect” the progress of investigations “in the face of political allies”.
NEWSPAPERS REPRODUCE INACCURACY
The wording of Minister Alexandre de Moraes' decision led to several inaccuracies in texts published by the media. Even the vehicles that pointed out that the messages were exchanged in October 2022 did not highlight the fact that Ramagem had already been out of Abin for 6 months.
Newspaper – the São Paulo newspaper he wrote that the messages were from 2020: “In the message from 2020, advisor Luciana Almeida says […]”.
Estadão – the oldest newspaper in circulation in São Paulo did not inform When were the messages: “Luciana writes to Ramagem’s assistant when informing the number of investigations”.
The globe – informs the correct year (2022) but the wrong month (November): “The dialogue took place in November 2022, right after the elections in which then-president Bolsonaro was defeated”.
UOL – the largest internet portal in Brazil only published the image of the messages, but without informing the year.
G1 – the Grupo Globo portal noted that it was 2022 and that Ramagem was already out of Abin, but did not explain what this meant for the reader: “At the time of the exchange of messages, in October 2022, Ramagem was no longer director of Abin”said the portal.
There is still confusion caused between the documents from the Attorney General's Office and Alexandre de Moraes' decision. In the case of the PGR, it is recorded that the messages were between Ramagem and Luciana, Carlos Bolsonaro's advisor. Here's the complete of the document (PDF – 216 kB).
The order from the STF minister states that it was a conversation between Luciana and another woman, Priscilla – although in the image it is clear that it is Ramagem, who responds “thank you very much” during part of the dialogue.
