In the process of the mass killing of prisoners in the Sachsenhausen concentration camp during the Second World War, the psychiatric expert who assessed the 100-year-old defendant’s ability to stand trial cannot be questioned on the matter.
Brandenburg / Havel – This was decided by the 1st criminal chamber of the Neuruppin Regional Court on Friday after a corresponding application by the defense attorney. The background to this was an assurance from the expert to the defense attorney that he would not ask the accused any questions about the allegations. The 100-year-old had commented on the allegations after the written report at an investigation. This should not be used because the expert had previously asked a question that aimed too closely at the allegations, the court said in a decision.
According to the indictment, the 100-year-old is said to have assisted the murder of thousands of prisoners as an SS guard in the concentration camp from 1942 to 1945. The defense attorney had already stated at the beginning of the process that his client would not comment on the allegations. On the second day of the trial, however, the defendant made a spontaneous statement denying that he had ever worked in the Sachsenhausen concentration camp. (dpa)
