Entities presented 18 cases to the Court against laws that they claim violate freedom of expression and education
A LGBTI+ National Alliance and ABRAFH (Brazilian Association of Homotransaffective Families) presented to the STF (Federal Supreme Court) a set of 18 lawsuits against municipal laws and a state law that prohibited the use of “neutral language” or “non-binary dialect” in their territories. The petitions were distributed among the court ministers.
The entities claim that the laws violate fundamental rights such as freedom of expression and freedom of education by prohibiting the use of neutral language, a form of communication that seeks to adopt neutral terms instead of feminine or masculine.
According to the associations, the ban entails censorship of teachers, who are prevented from teaching on the topic, and affects the dignity of non-binary people by prohibiting them from using the language in which they feel most comfortable. Furthermore, they recall Supreme Court decisions that recognized the rights of the LGBTI+ population.
While an ADI (Direct Action of Unconstitutionality) questions a state law in Amazonas, ADPFs (Arguments of Non-Compliance with Fundamental Precepts) refer to municipal legislation in the following cities:
- Águas Lindas de Goiás (GO);
- Balneário Camboriú (SC);
- Belo Horizonte (MG);
- Betim (MG);
- Boa Vista (RR);
- Ibirité (MG);
- Jundiaí (SP);
- Marituba (PA);
- Muriaé (MG);
- Navigators (SC);
- Novo Gama (GO);
- Petrópolis (RJ);
- Porto Alegre (RS);
- Rondonópolis (MT);
- São Gonçalo (RJ);
- Uberlândia (MG) and
- Votorantim (SP).
The shares were drawn for minister Cármen Lúcia and ministers Flávio Dino, Alexandre de Moraes, Dias Toffoli, Luiz Fux, Nunes Marques, Edson Fachin and André Mendonça.
On Monday (May 20), Moraes suspended two pieces of legislation that prohibited the use of “neutral language” in Águas Lindas and Ibirité. The decision is preliminary in nature and will be analyzed by the other ministers from May 31st in the virtual plenary of the STF, but it is already valid.
