(The JNJ made this decision after listening to the presentation of its regular member María Zavala on the ordinary disciplinary procedure followed by Benavides, in which it was demonstrated that he committed four very serious offenses when he represented the institution as a whole, which meant a “major harm.”
The case concerns Benavides’ alleged interference in the investigation opened by prosecutor Bersabeth Revilla against her sister Enma Benavides, reported for releasing alleged drug traffickers in exchange for giftsand the preparation of a controversial low productivity report prepared by Supreme Prosecutor Azucena Solari, which served to remove Revilla.

“It is proven that the reports are inconsistent, as additional evidence is the statement of former advisor Jaime Villanueva,” said Zavala in reference to the statements of the witness and collaborator of justice who confirmed the removal plan against Revilla.
It is proven that the reports are inconsistent, as additional proof is the statement of former advisor Jaime Villanueva.
In this sense, Zavala recommended dismissing Patricia Benavides as the titular supreme prosecutor and from the position of prosecutor of the Nation for having interfered in the tax investigation against her sister, having removed Revilla from her position without due motivation and having given her “treatment degrading”.

He also proposed his dismissal for having appointed a prosecutor to replace Revilla who had previous sanctions and who had been denounced for the removal itself.
“He has violated the duty to maintain impeccable conduct,” Zavala noted about Benavides’ sister.
Regarding the prosecutor Azucena Solari, her dismissal was approved because she did not act independently, and incurred very serious offenses, established in the career law of the Public Ministry.

In parallel, Patricia Benavides is currently being investigated for leading an alleged criminal organization of influence peddling in the Public Ministry for which she had a second request for suspension from office for 36 months in progress..
On May 2, the suspended prosecutor demanded that the JNJ reverse “a disastrous milestone” for the public administration, by requesting that the suspension imposed against her last December be eliminated.
