Lawsuit on citizen’s income: INPS risks an 850 million blow
As many as 850 million euros in “greater costs” that theInps would have to be paid if the Constitutional Court ruled on the constitutional illegitimacy of the ten-year residence requirement established by the law on Basic income. This is the estimate reported by LaPresse, based on an internal INPS document drawn up by Studies and Research Directorate – General Statistical Actuarial Coordination.
The civil lawsuit brought by six citizens and the risk of a chain effect
It all stems from an ongoing civil case between INPS and six foreign EU citizens. The internal signature document Gianfranco Santoro and Giulio Mattioni, INPS executives, is dated May 8th. However, everything depends on what will be the first ruling relating to two other proceedings pending before the Court European Court of Justice of Luxembourg which always concern the residence criterion but for political refugees and holders of a single work permit. The “problem” for INPS would naturally not be the six citizens in the ongoing civil case. But the fact that a ruling in their favor would open up the possibility of all other people in their same position appealing. And these are those 106 thousand families whose requests for welfare benefits were rejected between 2019 and 2023 due to the lack of the 10-year residency requirement.
From here we reach the monstrous figure of 850 million euros. Of course, LaPresse reports, among jurists there are also those who are not convinced that ex post restitution can be obtained on an application that has already been rejected but the social security institution is taking into account the most drastic scenario.
And the costs of the inclusion allowance are also likely to rise…
A second calculation carried out by the INPS indicates how much more the inclusion allowance (which replaced the citizen’s income) would cost over the next nine years compared to forecasts, if the “qualified” residence requirement were no longer met: that’s 2.2 billion euros between now and 2033.
