Genoa – The strike is practically guaranteed, but not now, not at this moment. For protest against the “bad reform” on the separation of careers, the magistrates are waiting for the provision to arrive in Parliament and, only then, will they officially proclaim the abstention from work which, from what appears to be the position of the central steering committee of the ANM, could be even for several days.
“There is no type of reservation or caution – he explains the president, Giuseppe Santalucia – because it is a wrong reform that will make the judicial system turn the page.”
Towards a national demonstration
In the meantime, however, the robes are preparing a national demonstration and say they are ready to participate in any committees in a possible constitutional referendum. All accompanied by a mobilization that will affect the civil community, from universities to European institutions. Thus, as announced immediately after the approval of the bill, therefore the robes are preparing to strike without, however, creating fractures that could prove irreparable, but waiting for the right moment to make their voice heard. “When necessary, the strike will have to be implemented and will have to strengthen and multiply our communication capacity – highlights Santalucia in his introductory report – One day, two or three, it is not a question of days, all those that will be needed at the moment in which it will be necessary”.
In the meantime, however, the National Association of Magistrates will also try to get as close as possible to public opinion, to explain his reasons against the separation of careers desired by the Meloni government. For this reason, the final document, approved after more than seven hours of meeting, talks about developing an “innovative and effective communication strategy also through the support of communication experts”. “But without using slogans or likes – Santalucia had pointed out in the morning -, maintaining a style that is befitting of a judiciary in the country”. Relying, if necessary, also on social networks.
“They want to weaken the judiciary”
According to the unitary document signed by the ANM, the aim of the reform is to “weaken the judiciary”, creating two CSM with a “sneaky entrustment of the management of the two bodies to the politically appointed component, and through the attribution of disciplinary competence to a High Court, which is configured as a special court provided only for the ordinary judiciary”. “The separation of careers – the robes comment – it does not respond to any need for improvement of the justice service, but determines the isolation of the public prosecutor, mortifying his guarantee function and abandoning him to a security logic, as well as laying the foundations for the concrete risk of his being subjected to power executive”. A provision which, according to the magistrates, “takes away spaces of independence from the jurisdiction, reducing the guarantees and rights of freedom for citizens”.
