Measure applies to cities with up to 50,000 inhabitants and which are in an emergency situation; victims in RS can benefit
The federal government published in this Thursday’s edition (May 16, 2024) of Official Diary of the Union a decree that authorizes the exemption from supporting documentation for withdrawal from the FGTS (Service Time Guarantee Fund) in the event of an emergency situation or state of public calamity recognized by the Ministry of Integration and Regional Development.
According to the document (complete – PDF – 117 kB), the measure applies to cities with up to 50,000 inhabitants. With the publication of the decree, Caixa Econômica Federal has up to 5 working days to edit the normative acts referring to administrative and operational procedures.
The decree establishes that “the holder of the linked account who does not have the means to prove their residential address may do so by presenting a declaration issued by the municipal or Federal District government, or by presenting their own declaration, with Caixa Econômica Federal being responsible for verifying the veracity of the declaration in official federal government records”.
On May 3, Caixa announced that those affected by the flood in Rio Grande do Sul could withdraw their FGTS balance. Saque Calamidade was made available to residents of municipalities that have declared a state of public calamity or emergency situation, duly recognized by federal government decree.
The modality can only be activated in exceptional cases. Normally, the FGTS can be withdrawn in case of unfair dismissals, when the worker turns 70 or in the birthday withdrawal, which offers the withdrawal of part of the balance in the month of the worker’s birthday.
