The Administrative Court of Vaasa has rejected the appeal regarding the noise restrictions imposed on the restaurant Bystrand from Nauvoo. Minister Bergqvist is a partner in the estate that owns the restaurant property. The restaurateur pays rent to the estate.
The restrictions concerned, among other things, playing music on the restaurant’s terrace during the summer.
The incident started last year, when the owners of the property in the vicinity of the restaurant complained about the noise from music events on the restaurant’s terrace to the Parainen Environmental Protection Authority. The task is handled by the city’s building and environment board. Nauvo is part of the city of Parainte.
The complainants demand that music events on the restaurant’s terrace must be banned.
The board decided to limit the number and duration of summer music events.
When the board had given its decision, Bergqvist sent an email Good luck to the local decision-makers and officials and asked if it is still possible to deal with the matter in the city’s bodies.
This raised questions about whether the minister was trying to use his influence to change the decision through a roundabout way.
Bergqvist is the former chairman of the Parain City Council and a current rank-and-file member of the City Council. He gave up his position as chairman due to his duties as a minister.
At the moment, Bergqvist is Petteri Orpon (kok) Minister of Sports, Sports and Youth of the Government.
This is how Bergqvist commented on his activities in the field last year in an interview with Helsingin Sanomat:
“In retrospect, it’s easy to see that you should never have contacted anyone in this matter. It wasn’t wise. It was my mistake and I am truly sorry.”
In the end, the estate appealed the decision of the Paraine Building and Environment Board to the Vaasa Administrative Court. Neighbors who complained about the restaurant’s noise also filed their own complaint with the court.
In court the estate demanded the annulment of the board’s decision. In their view, the decision was against the law and unreasonably restricts the freedom of business.
The neighbors who initially complained to the city about the noise, on the other hand, demand that music performances held outside the restaurant must be completely banned.
In May, the Administrative Court rejected both appeals. It considered that the shareholders of the estate did not have the right to appeal in the case and the neighbors had filed their own appeal late.
The decision can be appealed to the Supreme Administrative Court if it grants permission to appeal.
