Authors of the actions that called for the impeachment of senator Sérgio Moro (União-PR), the Brazilian Federation of Hope, which includes the PT, of president Luiz Inácio Lula da Silva, and the PL, of former president Jair Bolsonaro, will not present appeals to the Federal Supreme Court (STF). This Tuesday, the 21st, the Superior Electoral Court (TSE) unanimously decided to acquit the former Lava Jato judge on charges of abuse of economic power and slush funds.

In a trial that lasted four hours, the TSE freed Moro from losing his position as senator and becoming ineligible until 2030. The score was 7 to 0. The ministers followed the statement by rapporteur Floriano de Azevedo Marques, who opened the vote against the revocation. Alexandre de Moraes, André Ramos Tavares, Cármen Lúcia, Kassio Nunes Marques, Raul Araújo and Isabel Gallotti were also against the loss of the mandate.
The appeals sent to the STF are the last possibilities that the parties have to try to provoke the parliamentarian’s conviction. Moro was accused of having unbalanced the election for the Senate of Paraná in 2022. According to the captions, the illegality would have occurred after Moro ran for the Legislature after announcing his pre-candidacy for the Presidency, which ended up not being carried out.
Appeals against TSE decisions were alternatives adopted by Deltan and Bolsonaro
Recently, Bolsonaro filed an appeal with the Court asking for the suspension of the TSE decision that made him ineligible until 2030, from June of last year. In April this year, the Attorney General’s Office (PGR) asked the STF to deny the request made by the former president. On the 9th, it was decided that the rapporteur of the action would be Minister Luiz Fux.
Also in June last year, STF minister Dias Toffoli denied the request of former federal deputy Deltan Dallagnol (Novo-PR) to suspend the revocation of his mandate, as determined by the Electoral Court. In May, the TSE convicted the former prosecutor, also for the maximum score, for failing to comply with the Clean Record Law.
