Republican district judge David Counts, who was appointed by former President Donald Trump, on Monday rejected a federal ruling against Jose Gomez Quiroz, who was convicted of buying a firearm while out on bail. Quiroz had appealed that ruling because the Supreme Court ruled earlier this year that people can carry a gun in public to defend themselves.
The federal court in Texas ruled in his favor on Monday. Judge David Counts ruled that, despite the pending charges against him, Quiroz should simply be able to buy a gun. “The Second Amendment is not a ‘second-class right’,” Counts said. “No longer can courts dismiss a constitutional right.”
