President of the STF states that the decision belongs to Congress, which can vote to prohibit defendants from reporting on Tuesday (June 11)
The president of the STF (Supreme Federal Court), Roberto Barroso, stated on Monday (June 10, 2024) that plea bargain agreements are “perfectly legitimate” as long as the arrest is legal.
In an interview with the program Roda Viva”, from TV Cultura, Barroso declared, however, that the issue is political and must be deliberated by Congress. According to him, “the award-winning collaboration has worked with the adjustments that the Supreme Court imposed as a positive tool”.
In Barroso’s understanding, denunciation is “unacceptable” if the defendant is unlawfully imprisoned to be forced to report. But, if the instrument is offered as a way to reduce your time in prison, it is legitimate and positive.
Last Wednesday (June 5), the president of the Chamber, Arthur Lira (PP-AL) decided to file an urgent request for the processing of the bill that prohibits collaboration agreements with people in custody.
The bill was never voted on and could return to the agenda this week. If approved by the president of the Lower House, the text can be voted directly in the Chamber plenary, without going through committees.
The text establishes that a plea bargain can only be validated if the accused responds freely.
According to the Power360the perception behind the scenes is that this is a reaction from deputies to the STF’s decision to arrest the congressman Chiquinho Brazão (União Brasil-RJ), based on the plea bargain of former military police officer Ronnie Lessa.
