The rule, which did not specify the exact reason for affecting presidential functions, was published in the official newspaper El Peruano by the Presidency of the Council of Ministers (PCM).
There it was noted that the Peruvian Prime Minister, Gustavo Adrianzén, has ordered that the Public Prosecutor Specialized in Constitutional Matters exercise the representation of the Executive in the process that will be brought before the Constitutional Court (TC).
In this sense, he reported that on May 17, the Council of Ministers granted authorization to file the jurisdictional lawsuit against the Public Ministry and the Judiciary of that country “for impairment in the strict sense of the proper exercise of the powers and functions of the president.” of the Republic”.
Once this approval was granted, he added, the president designated the president of the Council of Ministers to present the claim and represent her in the process, so the PCM issued the resolution that ordered the Public Prosecutor Specialized in Constitutional Matters to represent the Executive. .
The conflict of powers occurs when a power or state entity adopts decisions or deliberately avoids actions, affecting powers or attributions that the Constitution and organic laws confer to another.
Boluarte is being preliminarily investigated by the Attorney General’s Office (general) for the alleged commission of corruption and bribery crimes, for the so-called ‘Rolex case’, which involves the use of undeclared luxury watches and jewelry, as well as an alleged case of personal cover-up during the investigations being carried out against one of his brothers, Nicanor Boluarte, for alleged influence peddling.
This Tuesday, lawyer Eduardo Barriga, legal representative of the president, maintained in a court hearing that the Prosecutor’s Office has violated the rights to defense and due process of the ruler during the investigation opened by the ‘Rolexgate’ case.
Judge Juan Carlos Checkley, of the Supreme Court of Preparatory Investigation, listened to Boluarte’s lawyer, and to the representatives of the Prosecutor’s Office and the State Attorney General’s Office in the hearing to evaluate the protection of rights presented by his defense, who requested that urge the attorney general, Juan Carlos Villena, to carry out due control of tax actions as provided in the Criminal Procedure Code.
Villena also summoned the governor of the Ayacucho region, Wilfredo Oscorima, to testify, who He is investigated for alleged generic active bribery after having assured that he lent the watches to the ruler Boluarte.
