An 8-year-old child was caught in the middle of a violent encounter between his divorced parents and his father's new girlfriend.
Couple began to abuse the man's ex-wife and the child when the child's mother refused to give the child to the man.
The crime took place in Helsinki in January 2020. The mother and 8-year-old son had arrived at the man's home yard. The victim's small baby had also been on board.
The victim and the child's father's new girlfriend had immediately had an argument, which had escalated into a fistfight. The man described the situation as “hair wrestling”.
The couple the woman hit the victim in the face with high heels. A witness who arrived at the scene said that the man punched the woman and both of them tore her by the hair.
When the child defending his mother had intervened in the situation, he was also hit in the neck.
The couple's woman, born in 1991, was sentenced to eight months' conditional imprisonment for two assaults in the Helsinki district court.
A man born in 1992 was sentenced to seven months in prison for assaulting his ex-spouse. The woman was ordered to pay 300 euros compensation to the child.
However, instead of a prison sentence, the man was ordered to do 210 hours of community service. When imposing the punishment, the man's other recent assault convictions were taken into account.
The couple was ordered to pay 1,600 euros in compensation to the child's mother.
All parties appealed to the Court of Appeal. The Helsinki Court of Appeal did not grant permission for further processing.
