Paulo Alexandre Barbosa has political rights suspended for 5 years due to exemption from the competition when hiring advertising on clocks and panels
O TJ-SP (Court of Justice of the State of São Paulo) sentenced, in the second instance, the former mayor of Santos and federal deputy Paulo Alexandre Barbosa (PSDB-SP) for committing administrative improbity with damage to the treasury. Here’s the complete of the decision (PDF – 1 MB), of May 22.
The toucan responded for undue exemption from bidding for the permission to use it to exploit advertising on clocks and panels fixed in the city on the coast of São Paulo.
Barbosa was sentenced to:
- suspension of political rights for 5 years;
- payment of a fine equivalent to the damage to the treasury consistent with the value of the monthly public price in the period from May 6, 2013 until compliance with the injunction;
- prohibition of contracting with public authorities or receiving tax incentives or benefits for a period of 5 years;
- compensate the damage to the treasury, in solidarity with the contracted company.
According to the public civil action filed in 2018, the then mayor violated the Bidding Law in hiring companies that sell advertising on clocks, panels and pedestrian protection signs spread across the city’s streets.
Judge Décio Notarangeli understood that there was an undue exemption from bidding without any formalization. Furthermore, the company contracted at the time benefited from the act, no longer paying the monthly public price and advertising fees, freely exploring advertising in the space.
