Amid strong criticism of the health sector in Peruthe Government of said country decided to enact Law 32033, which “obliges pharmacies and pharmacies to have 30% generic medications,” said the Ministry of Health (Minsa) in a statement.
Furthermore, the norm imposes fundamental conditions for the execution of complementary services that are currently carried out in said establishments. Failure to comply with the law will result in fines and sanctions.
In context, the lawwhich was approved on May 9 by Congress, was signed in a public ceremony held at the Government Palace in Lima by President Dina Boluarte, who said that her Government has “a clear vision: no Peruvian should postpone their health due to the cost of medications.
He assured that this law “strengthens the regulation of pharmaceutical products, in addition to establishing the obligation to maintain a minimum stock of generic medications throughout the private sector at the national level” and that with the promulgation the commitment to fight against monopolistic practices and of market segmentation.
The minister also recalled that previous national legislation established that only 40 medications were included in the list of generics that must be compulsorily marketed in pharmacies and pharmacies in the country.
The services that will be modified
According to local media, the services that will be modified from now on are: medical consultations, injections, performing clinical analyses, collecting laboratory samples and health campaigns.
It is important to highlight that in a statement from the Ministry of Health (Minsa) it clarifies that it is not prohibited to perform this type of services; but it is mandatory that you have qualified personnel.
“Regarding the application of injectables in pharmacies and botanicals, we specify that the information provided by a media outlet that this practice is prohibited is not correct,” said one of the sections of the statement.
And he added: “In this regard, pharmacies or botanists that wish to present complementary services (application of injectables) must have qualified and specific area For this purpose, in addition to carrying out the respective procedure before the health authorities“.
