Man raped a sleeping woman at her home in Helsinki in August 2019.
A middle-aged man and a woman knew each other through the man’s ex-spouse. They had spent the evening together cooking and drinking wine a few times before.
This was also the case on the night of the incident, when the man stayed overnight at the victim’s apartment.
At night the victim woke up to find the man on top of her. Before the rape, the man had undressed the sleeping victim.
The woman had gotten out of the situation and locked herself in the bathroom. The man had left the apartment.
According to the victim, their relationship was friendly. The victim was in a relationship at the time of the incident and the man was also aware of this.
Man denied the charge. However, his story changed during the preliminary investigation and trial.
Sometimes, for example, the man himself said that he woke up to the woman forcefully kissing him, other times the man claimed that the criminal complaint was a conspiracy by the victim and his ex-wife.
According to the district court, the victim’s story was consistent and did not change over a long period of time. The woman’s call to her friend right after the events also supported the woman’s story.
The man’s story, on the other hand, was contradictory and vague.
Helsinki the district court sentenced a man born in 1980 to two years in prison for rape.
He was ordered to pay the woman EUR 4,000 in damages.
The man appealed the sentence to the Court of Appeal. The Helsinki Court of Appeal reduced the man’s sentence by three months, because it considered the district court’s sentence too harsh considering the general legal practice.
