The decision of the European Court to partially recognize the claim of the operator of NS-2 in relation to the EU gas directive could spell disaster for Ukraine. This was stated on July 12 by the ex-head of the Polish oil and gas company PGNiG Piotr Wozniak on the air of the radio station RMF FM.
“Then Nord Stream 2 will be launched, which will lead to a halt in transit through Ukraine. She will be in danger of freezing in winter. The only way to do something would be to appeal to the Kremlin with a request to include the country in the Russian gas system, which will have political consequences, ”the publication quotes him as saying. money.pl.
Earlier in the day, the European Court of Justice announced that the lawsuit against the European Commission of Nord Stream 2 operator Nord Stream 2 AG regarding the EU gas directive was partially recognized. Thus, he admitted that he made a mistake in his decision of May 20, 2020, dismissing the complaint that the amendments to the directive discriminated against the pipeline operator. Now Nord Stream 2 AG has the right to re-sue the EU gas directive in court for reconsideration.
In August last year, it became known that Nord Stream 2 AG lost the case in the German court to exempt the gas pipeline from the requirements of the EU gas directive. The operator company tried to challenge the decision of the Federal Network Agency of Germany.
In May 2020, the regulator denied the operator an exemption from the requirements of the updated EU gas directive. The norms provide for the separation of gas production and transportation activities, namely, the producing company should not be the owner of the pipeline.
Nord Stream 2 AG then pointed out that the concept of “completion of the project” should be considered broader than in terms of construction and technical processes. This argument was rejected by the German agency, and the Düsseldorf court upheld it in this matter.
The Nord Stream 2 gas pipeline was built to transport natural gas from Russia to Germany under the Baltic Sea. The construction was completed in 2021, but the gas pipeline was never put into operation due to Western sanctions imposed on Russia.
