“The Prosecutor’s Office of the Nation, through the Area of Illicit Enrichment and constitutional complaints, presented today, before the Congress of the Republic, the constitutional complaint against Dina Ericilia Boluarte Zegarra, in her capacity as President of the Republic, as the alleged author of the crime of improper passive bribery, to the detriment of the State,” the Public Ministry detailed on the social network X.
The facts refer to the fact that the president “would have received – as a donation – from the regional governor of Ayacucho, Wilfredo Oscorima Núñez, three ‘Rolex’ brand watches, a pair of gold hoop earrings with diamonds and a ‘Bangle’ bracelet. ‘with 94 brilliants
It is addressed to Congress, whose Subcommittee on Constitutional Accusations must determine its origin before beginning a parliamentary journey that ends in the plenary session, which, ultimately, must determine whether to recommend charging Boluarte for this case.
The first time this figure was used against a sitting president was during the mandate of Pedro Castillowhich then opened a legal debate, since article 117 of the Constitution states that a sitting president can only be accused of treason, preventing parliamentary, regional or municipal presidential elections or for dissolving Congress irregularly. .
It details that the facts refer to the fact that the president “had received – as a donation – from the regional governor of Ayacucho, Wilfredo Oscorima Núñez, three ‘Rolex’ brand watches, a pair of gold hoop earrings with diamonds and a bracelet ‘Bangle’ with 94 diamonds for the purpose of carrying out acts typical of her position as President of the Republic.”
The complaint has 63 pages in which the Public Ministry presents its arguments and evidence to demonstrate that the president had committed the aforementioned crime.
The fiscal thesis maintains that the purchase of watches and jewelry by the governor coincide with visits he made to Boluarte, and affirms that the Executive has issued several emergency decrees and supreme decrees that would have benefited the governor and his region.
Which would indicate that the president had acted “willfully” by receiving these objects as “donations.”
Boluarte initially said that the watches were his, “the result of his effort,” but weeks later he acknowledged that “they were a loan” from his friend Oscorima and stated that it had been “a political mistake” to accept the donation.
