Judgments|Two young men assaulted a teenage boy in the stairwell of this home. The act was interrupted when the victim’s father came to the scene.
During the event A 16-year-old boy and a 19-year-old man assaulted a teenage boy in Vantaa in January of last year.
The youngest of the perpetrators had agreed to meet at the home of his peer. According to the authors, the purpose was to investigate a case in which a 16-year-old boy had insulted the 19-year-old defendant’s little sister.
The victim thought he was only meeting his peers, but he also met his angry older brother at the door of his home.
Twosome started hitting the victim and kicking him with his knee. The victim fell to the ground and even then the accused continued to assault the victim. The situation was interrupted when the victim’s father arrived.
When fleeing the scene, the perpetrators took with them the snuff discs that fell out of the victim’s pocket and the mobile phone.
Later, the defendants had compensated the victim 300 euros for the phone.
Senior one of the accused admitted to beating the victim because she had hurt his little sister. He said that he took the victim’s belongings “on the spur of the moment”.
The younger of the accused denied the charge and described the situation as unclear. According to him, the situation had “been beaten both ways”.
The district court of Itä-Uusimaa sentenced a man born in 2003 to one year and six months of conditional imprisonment for robbery.
In 2007, the boy was sentenced to one year and one month of suspended imprisonment for a robbery committed as a young person.
Junior of the perpetrators appealed their verdict to the Court of Appeal. He denied participating in the robbery.
The Court of Appeal found that the boy had gone to the victim’s place “to teach”, not to steal property. Since the goods had been taken by an older accomplice, the younger son was not considered guilty of robbery.
The Helsinki Court of Appeal changed the boy’s sentence from robbery to assault committed as a young person. In the Court of Appeal, the boy’s sentence was reduced to 45 days of suspended imprisonment.
