Altroconsumo’s battle in Italy over dieselgate
Altroconsumo had initiated a class action for consumers who purchased VW Group vehicles (Audi, Seat, Skoda) with engines EA189 between 2009 and 2015, requesting compensation of 15% of the purchase value. On May 25, 2017 the Court of Venice had declared the collective action promoted by Altroconsumo admissible and set the first hearing for 6 December 2017. The first sentence was issued by Court of Avellino, the n. 1855/2020 of 10 December 2020, which ascertained the deceptive commercial practice implemented by the German group, jointly condemning Volkswagen Aktiengellschaft (Germany) and Volkswagen Group Italia to compensation for financial damage quantified as 20% of the price of the car and to the payment of legal fees.
In May 2024 Altroconsumo and Volkswagen reached an agreement to close the class action with over 50 million euros allocated by Volkswagen Group Italia, thus putting an end to the legal matter that began in 2015.

Dieselgate scandal

The German company had installed a illegal software, known as a “defeat device”, on millions of diesel vehicles for manipulate tests of emissions. This device reduced nitrogen oxide (NOx) emissions only during tests, while in normal driving conditions emissions they exceeded the limits up to 40 times legal.
It was later discovered that the software was present in approx 11 million vehicles globally, involving the Volkswagen, Audi, Skoda and Seat brands with EA189 diesel engines.
After the scandal Volkswagen faced enormous financial repercussions, with more $25 billion paid in settlements and fines in the United States. In Europe, the case generated numerous class action and compensation agreements. The scandal led to changes in Volkswagen’s leadership, with the CEO resigning Martin Winterkorn and the firing or arrest of other executives.
