For the senator, the Supreme Court must restrain itself from making decisions that are up to Congress
The senator and former judge responsible for Operation Lava Jato, Sergio Moro (União-PR), argues that the STF (Supreme Federal Court) adopts a “institutional humility” in the decisions you make from now on. The congressman, recently acquitted by the TSE (Superior Electoral Court) in a case that called for the revocation of his mandate, said that the Supreme Court must act with more “self-restraint”.
“It is necessary to have the perception of a certain institutional humility. That there are things that must be resolved by other powers, and that there are things that are not yet ripe to be resolved. It applies to everyone, not just the Supreme Court”declared the senator, in interview The Folha de S. Paulo published on Saturday (January 15, 2024).
Moro said that Congress and the STF are on equal footing, but that it is necessary to recognize the nature of each of the powers to “do not advance certain signals”.
“Congress is no better or worse than the Supreme Court. But parliament has representatives who were elected. If we make the wrong decisions, the population can fire us every 4 years [se deputado], every 8 years [se senador]. The Supreme Court has an important role, but it is a non-elected and lifelong authority. Therefore, it is recommended that there be a certain amount of self-restriction. The Supreme Court has to apply the law in specific cases, and not make laws. He has to be careful not to advance certain signals”, he stated.
For the senator, there is a climate of “persecution” against the people who were part of Operation Lava Jato. He credited the scenario to the president’s management Luiz Inácio Lula da Silva (PT).
“In relation to Lula, they say I would have done this and that. But the fact is that my decision [de condenação] it was reaffirmed in other instances and by higher courts. It was institutional work. Then there was revisionism — in my opinion, political. We respect the decisions of higher courts. But, in my opinion, the annulment [da condenação de Lula] It was a miscarriage of justice.”declared Moro.
Despite his speech against Lula, the senator did not provide definitive support for the possible return of the former president Jair Bolsonaro (PL) to power, saying that it is a question for 2026.
“So, as much as I have differences with the Bolsonaro government, my focus today is to oppose the Lula government. But we have to discuss the present, and not the issues of the past”he said.
