The president of the Superior Electoral Court (TSE), Alexandre de Moraes, denied an appeal presented by the defense of former president Jair Bolsonaro for the Federal Supreme Court (STF) to analyze the Electoral Court’s decision that made him ineligible.
By denying it, Moraes argued that the appeal does not meet the requirements set out in law.
“In this way, the controversy was decided based on the peculiarities of the specific case, so that changing the conclusion of the appealed judgment presupposes a change in the factual and evidentiary set of records, a measure that proves to be incompatible with the Extraordinary Appeal”, says the decision of Friday (24), but published this Sunday (26).

Moraes denied the extraordinary appeal regarding the conviction, in October 2023, of Bolsonaro and his running mate, Walter Braga Netto, for political and economic abuse during the celebrations of the Bicentenary of Independence, in Brasília and Rio de Janeiro, to promote candidacy.
At that time, the TSE determined the ineligibility of both for eight yearscounting from the 2022 election.
It was Bolsonaro’s second sentence of ineligibility for eight years. However, the eight-year period continues to apply due to the first conviction and will not be counted twice. The former president is prevented from participating in elections until 2030.
In his first conviction, the former president was also convicted by the TSE of abuse of political power and misuse of the media for the meeting held with ambassadors, in July 2022, at Palácio da Alvorada, to attack the electronic voting system.
