O TRF-3 (Federal Regional Court of the 3rd Region) denied on Monday (Aug. Anac (National Civil Aviation Agency) and the Union. The group asks the Court not to allow the Congonhas airport (SP) to be granted to the private sector. Here’s the intact of the sentence (72 KB).
In the decision, federal judge Paulo Sérgio Domingues, from the 6th Panel of the TRF-3, says that there is no “necessary requirements for the granting of provisional urgent relief”. “I understand that the appeal reasons given by the aggravating party do not deserve acceptance”declared.
“On the alleged urgency, it is noted that the popular action was proposed almost 2 months after the publication of the notice, and that the administrative preparatory acts for the event have been carried out for months and are public. Apparently, there was enough time for the early action of the Judiciary”said Domingues.
The associations claim in the action that the concession of Congonhas airport to the private sector “will cause damage to the environment and the urban order”. According to the plaintiffs, “there will be a greater discharge of pollutants into the atmosphere, damage to the hearing and mental health of residents around the airport, restrictions on urban mobility due to the increase in traffic in the region and a decrease in the safety of the population that lives or transits in the region as a result of the increased risk of accidents”.
According to federal judge Paulo Sérgio Domingues, the “possible harmful socio-environmental impacts must be dealt with at the proper and later time, that is, of their licensing”.
“In the case of the case file, it does not seem to me that environmental rights and principles have been neglected, behold, it must be repeated, what has been pondered so far by the appellee, by the TCU (Union Court of Auditors) and by the lower court. ”declared.
