Decision was unanimous; Former deputy asked for suspicion in conducting inquiries into fake news and digital militias
Unanimously, the ministers of the stf (Federal Supreme Court) denied the former deputy’s appeal Roberto Jefferson which called for suspicion of Alexandre de Moraes in conducting surveys of fake news and digital militias.
Minister Rosa Weber’s vote (read full – 97 KB) was accompanied by the 9 voting ministers. The score, then, was 10 to 0 against the request. Moraes was prevented from voting for being one of the parties involved in the process.
The trial ended this Friday (10.Feb.2023), in the virtual plenary of the Court. Weber argued that Jefferson appeals to motives of “mere procedural convenience” to ask for suspicion.
According to the minister, the former deputy seeks to question the determination of preventive detention by resorting to facts “occurred months (or years) ago, long before the aforementioned precautionary arrest or the initiation of this procedural incident”. She continues:
“A simple reading of the grounds set out by the arguer reveals that all the circumstances pointed out as evidence of the alleged capital enmity with the rejected magistrate relate to facts that occurred in the distant past, prior to the procedural arrest indicated by the arguer as a time frame to be considered”, he wrote.
Roberto Jefferson has been imprisoned in Rio de Janeiro since October 2022. The former deputy became a defendant for attempted murder after posting a video on the internet offending Minister Carmen Lúcia, of the STF, and attacking a team of police with gunfire and grenades federal officers serving an arrest warrant at their home.
In the decision that maintained preventive detention, Moraes cited the politician’s response to receiving federal agents as an aggravating factor.
“The very serious conduct of the prisoner at the time of his arrest in these records reveals the need to maintain the restriction of freedom, behold, Roberto Jefferson kept at home, even complying with precautionary measures, weapons of high offensive potential, in addition to a large amount of ammunition , effectively used to attack the lives of federal police officers”declared the magistrate in January 2023.
