The European Justice denied the registration of the brand created by Pablo Escobar's brother with which he intended to enter products and services into that market under the surname of the late drug trafficker. The first instance decision has appeal options.
From a foldable smartphone called Escobar Fold 1., to a cryptocurrency called Escobar Cash. These are the products offered by Escobar Inc., a company founded by Pablo Escobar's brother that has just been denied trademark registration by the European Union.
Escobar Inc. was founded in 1984 by his brother, Roberto de Jesús Escobar Gaviria, who spent 12 years in prison for his role in the criminal organization. Based in Puerto Rico, today it is the holding company that manages the family's assets, including intellectual property rights and licenses thereof, as indicated on its website.
On September 30, 2021, the company requested the European Union Intellectual Property Office (Euipo) to register the word sign Pablo Escobar as a trademark in the Union for a wide range of products and services.
The Court of Justice of the European Union rejected the application, determining that if the trademark were authorized, people would “associate the name of Pablo Escobar with drug trafficking and narcoterrorism and with the crimes and suffering resulting from them, rather than with their possible good actions in favor of the poor in Colombia”.
He added that registration was denied considering that the trademark was contrary to public order and good customs, and was based on the perception of the Spanish public, that it has a greater knowledge of Escobar for his crimes, so the trademark will be perceived as contrary to the values and fundamental moral norms prevailing in Spanish society.
Pablo Escobar led one of the most powerful criminal organizations in the world, called the Medellín cartel. Forbes estimated in 1987 that his fortune, thanks to cocaine trafficking, had reached more than $3 billion, although some accounts put it at much more.
