Parliament is discussing the total ban on abortion, also punishable by life imprisonment. The government will have access to all citizens’ data and will be able to prosecute them
Life imprisonment for women who have abortions, prison sentences of up to 25 years for the doctors who help them and, if that weren’t enough, a new “Family and Demography” Institute, an emanation of the ultra-right government, which will be able to participate as a public prosecutor in all proceedings judicial and administrative, for example in a divorce case, asking that it not be granted. In essence, the Warsaw government will be able to sue LGBTQ + parents, asking that they be deprived of their parental rights and will have access to data collected by any Polish body on every pregnancy, every miscarriage, even on every medical document. “It is clear that Poland has declared war on women,” says Marta Lempart, founder of the Ogólnopolski Strajk Kobiet (Polish Women’s Strike) movement.
War, like all wars, is fought on several fronts. The government of the ultra-nationalist PiS party has presented two bills that could aggravate the already tragic situation of women in Poland: the first establishes a total ban on abortion in Poland, even in the event of rape and if the mother is in danger of life. The termination of pregnancy would be equated to murder, a crime punishable by life imprisonment. In the case of a spontaneous abortion, the offender will be punished with a penalty of “from 3 months to 5 years of imprisonment”. Because, we read in the bill, paragraph 25: “A child is a human being from the moment of conception.” In addition to women, those who give any assistance, from doctors to associations that help women have abortions, will be punished.
Abortion is currently possible only for two reasons: rape and the danger of life for the woman but the pro-life would like to exclude this possibility as well. «The life of Polish women has already been turned into hell – Kamila Ferenc, Deputy Director of Federacja na rzecz Kobiet i Planowania Rodziny, Federation of Women and Family Planning -. For a year now in our country it has been banned even in the case of serious malformations of the fetus, a ban that leaves you speechless for the extent of its cruelty. The pain of women is caused by the soulless visions of the fundamentalist lobby, which has assumed the highest positions of power in Poland ».
But it is the second bill that is even more disturbing, if possible, the one that wants to create the “Family and Demography” Institute, which will be led by the ultra-right parliamentarian Bartłomiej Wróblewski, already known by Polish women because he was the author of the motion presented to the Constitutional Court which had led to the current limitation of the right to abortion. Constitutional Court which, it should be remembered, was considered illegitimate by the European Parliament after the reform wanted by the government, with this motivation: “The Polish constitutional court lacks legal validity and independence and lacks the qualifications to interpret the country’s Constitution”.
It will therefore be Bartłomiej Wróblewski, defined by the activists as the “Polish Torquemada”, to control the lives of women, with an operation that would give him the right and the power of a super-prosecutor. He, himself, 46 years old, lawyer and member of PiS, passionate mountaineer and ferocious anti-abortionist, will have the power to control the national database in which all the data on ongoing pregnancies, on interrupted ones, on medicines – pill will be kept. contraceptive included – of Polish women. Then, if he deems it appropriate, he could intervene in the courts, as a prosecutor. So much for the separation of powers.
Both bills, if approved, will be submitted to the Senate on December 14 and 15, with further passages to the Sejm if challenged, on December 17, meaning both bills could come into effect January 1, 2022.
Meanwhile, the women returned to the square last night with a demonstration in front of the Warsaw Parliament.
