Erdogan is now officially allowed to decide on military operations at home and abroad, according to a new regulation. Experts consider the new rules to be superfluous.
Ankara – In Turkey, President Recep Tayyip Erdogan apparently continued to expand its power. According to the Official Gazette, the so-called “Regulation on Mobilization and the State of War”, which had been in force since 1990, was repealed. This meant that the power to decide on mobilization and the state of war was withdrawn from the Council of Ministers and transferred to the Presidium. The opposition criticizes the new regulations.
“The President of the Republic can declare mobilization in the event of an uprising or behavior that threatens the indivisibility of the country and the nation from within or without, as well as in the event of a situation that requires war,” says Süleyman Bülbül, MP for the CHP to the newspaper NewsThis means that Erdogan can decide on the use of the military at home and abroad entirely on his own. On social media, the president’s critics are outraged by the new regulation. Experts, however, cannot understand this. The reasoning is plausible.
Erdogan was also previously able to decide on military operations alone
“I think this discussion is unnecessary. Because before 2017, the The power to declare a state of emergency rests with the Council of Ministers according to the Constitutionwhich was convened under the chairmanship of the President. In 2017, the presidential system was changed. At that time, the rules for declaring the state of emergency were also completely changed. The power to declare the state of emergency, including martial law, was completely transferred to the President,” says Turkish law expert Dr. Cemil Celik in an interview with fr.de from IPPEN.MEDIACelik was formerly a member of the Supreme Military Administrative Court in Ankara and has been living in exile in Germany since 2021. “According to Article 119 of the Constitution, the President of the Republic has the sole authority to declare a state of emergency in cases such as war, the outbreak of a situation necessitating war, mobilization and insurrection.”
Kemal Karanfil, a former judge at the Court of Cassation (Yargitay), sees things similarly. “Erdogan had already suspended parliamentary order after July 15, 2016, and was thus able to rule practically alone. Since then, he has been able to give the military the order to attack Kurdish positions in neighboring countries,” Karanfil told our editorial team.
New rules in Turkey are intended to convey the impression of the rule of law
“This is pure rubbish. They are trying to package Erdogan’s power in a legally correct way. Later, they can say that they acted according to the law. After all, these are regulations that must be adhered to,” said Karanfil. Ultimately, the idea is to create the impression that all the illegal things he does are within the framework of the law.
Turkish President Erdogan is not allowing his power in the country to be shaken. In the Rule of Law Index of the “World Justice Project” The country ranks 117th out of 142 countries. Human rights organizations such as Human Rights Watch and Amnesty International attest to the Türkiye There is a constant lack of rule of law and human rights violations. Even though Turkey only came second in the local elections on March 31, Erdogan is still in charge in the country. (erpe)
