At this point is where the figure of the King of Spain, Felipe VI, emerges, who plays a fundamental role in this process. The Executive would remain in office after applying article 101.1. But according to the Magna Carta, the King, after consulting the representatives designated by the political groups with parliamentary representation and through the president of Congress, will propose a new candidate for the presidency of the Government. Early elections would not be an option since, according to the Constitution, elections cannot be called if a year has not passed since the previous dissolution of the Cortes Generales. The Council of Ministers approved the dissolution of the Cortes to call the early general elections of 23-J on May 29, so a new electoral process could not be called until that day.
Another of the options being considered after the order of the general secretary of the PSOE is to raise a question of confidence to submit to a vote in the Lower House – which would endorse him in office or quite the opposite. According to article 112 of the Constitution, “the President of the Government, after deliberation by the Council of Ministers, may raise before Congress the question of confidence regarding his program or a declaration of general policy.”
