Former president (PL) spoke out after the STF minister denied an appeal that asked for the action that resulted in his ineligibility to be analyzed in the Court
The former president Jair Bolsonaro (PL) spoke out this Sunday (May 26, 2024) on the decision of Alexandre de Moraes, president of the TSE (Superior Electoral Court) and minister of the STF (Supreme Federal Court), to deny an appeal in which he asked for his unenforceability would be analyzed by the STF (Supreme Federal Court).

The TSE condemned the former president for abuse of political power and misuse of the media in June 2023 – which made him ineligible until 2030. In October of the same year, the Court approved a 2nd ineligibility for Jair Bolsonaro and his vice, Braga Netto. In this 2nd decision, in addition to ineligibility, a fine of R$425.6 thousand was also stipulated.
The former Chief Executive filed an appeal against the decision, but his request was denied by Alexandre de Moraes. In May, the defense appealed again and asked the TSE to forward the case to the STF, which was denied on Friday (May 24). The decision document was only released this Sunday (May 26).
In the decision, Moraes said that the appeal did not follow the legal requirements for this type of action. The magistrate also denied allegations by Bolsonaro and Braga Netto that there was “restriction of the right of defense” of the 2 and that the Court’s decision would have violated the Constitution.
“The controversy was decided based on the peculiarities of the specific case, so that changing the conclusion of the appealed judgment presupposes a change in the factual and evidentiary set of records, a measure that proves to be incompatible with the Extraordinary Appeal”said Moraes.
