Determination is a response to the petition of entities that allege non-compliance with the decision on the unconstitutionality of the practice
The minister of STF (Supreme Federal Court) Flávio Dino scheduled a hearing for August 1st to discuss alleged non-compliance with the Court’s decision that determined the unconstitutionality of the so-called “secret budget”.
The order comes after a petition from entities that act as “friends of the Court”, such as Open Accounts Association, Transparency Brazil It is International Transparencyl, in the process and who communicated the “persistence of non-compliance with the decision”.
The call “secret budget” This is how the rapporteur amendments, or RP-9, were called, which allowed congressmen to allocate Union resources, but which were not detailed in the budget execution control system – however, it is not “secret”.
On December 19, 2022, the STF, by 6 votes to 5, declared the rapporteur’s amendments unconstitutional. At the time, the ministers agreed that there was a lack of transparency in the allocation of resources through the modality.
Dino will conduct the conciliation hearing. The following were summoned by the minister to appear:
- Paulo Gonet, Attorney General of the Republic;
- Bruno Dantas, president of TCU (Court Union accounts);
- Jorge Messias, chief minister of AGU (General Attorney’s Office of the Union).
Before scheduling the hearing, Dino had already asked the presidents of the Republic, Chamber and Senate to provide information on the topic and declared that “the interest of the Legislative and Executive Powers in complying with court orders is evident”. In May, the Chamber denied any non-compliance with the decision.
However, he states that he is faced with “facts that still require definitive clarification”.
