The European Commission has threatened to take Spain before the EU Court of Justice if it does not transpose the provisions of the directive to promote the use of renewable energies into its national legislation within two months.
Brussels has also given this ultimatum to France, Ireland and Hungary for having missed the deadline to adapt these European standards to national legislationwhich expired on June 30, 2021.
This directive establishes the legal framework for the development of renewable energy in electricity, heating and cooling, and transport in the EU, as well as a binding EU-wide target for 2030 for renewable energy.
It also includes specific rules for guarantees of origin, electronic certificates to inform end customers about the proportion of energy from renewable sources in a supplier’s energy mix.
The standards also introduce criteria for sustainability and saving greenhouse gas emissions for biofuels, bioliquids and biomass fuels, as well as rules on the verification of compliance with these criteria by said fuels.
In July 2021, the Commission already warned these four Member States of the continued failure to fully transpose the directive and now draws their attention to other gaps relating to the provisions on guarantees of protection. origin of energy from renewable sources, or on other issues related to the sustainability criteria and greenhouse gas emissions savings of biofuels.
The four countries now have two months to remedy the situation and notify the complete transposition of the directive to the Commission or, otherwise, the Commission can decide to bring the case to the CJEU.
