But the story of the dispute that we witness today between the Executive, Legislative and Judicial powers, actually began since Arturo Zaldívar became president of the Court, in January 2019.
From that moment on, the Obrador-Zaldívar alliance was agreed, which sought to hand over absolute control of the Judicial Branch to the head of the Executive Branch.
For this reason, one of the first illegal maneuvers ordered by Zaldívar as head of the Court was to secretly investigate his peers in order to, in this way, have tools of blackmail and pressure to achieve absolute control of the Supreme Court and the unconditionality of its members.
From the secret espionage ordered by Zaldívar, it was discovered that one of the ministers, Eduardo Medina Mora, had made financial movements abroad. The secret investigation did not reveal any irregularities, but the next step was, in the best Saldívar style, to adulterate the documents and the amounts of the investments in foreign banks.
The next step was – also in line with Zaldívar's habits and customs – to leak the adulterated information to a columnist from El Universal who, shamelessly and knowing that it was false, published it as a scoop.
The objective sought by Zaldívar was achieved since, in the midst of the scandal, no media dared to broadcast the clarifications and explanations of Minister Medina Mora, who ended up resigning from office on October 4, 2019.
This is also why it is worth remembering that paragraph III of Article 98 of the Constitution says: “The resignations of SCJN ministers will only proceed for SERIOUS CAUSES; “They will be submitted to the Executive and, if it accepts them, it will send them for approval to the Senate of the Republic.”
