It was just going to be the family of the first of two victims to sue Tesla, accused of having superficially assessed a suspension failure, or the cause of the fatal accident.
According to what was reconstructed by Reuters, four days before the accident which took place in September last year, in fact, the driver of the Model 3 in question, Nicholas G. Garcia, had brought his electric to a Tesla Store due to problems with controllability, steering, suspension, battery, electronic system and the ability to open the doors . The inspection, however, according to the prosecution, would have been too negligent and would have consequently neglected the seriousness of the problem, which in a few days would have caused the fatal accident. The lawsuit, filed in a Florida state court last week, verbatim states that the Model 3 involved in the accident had a “defective and unreasonably dangerous suspensionwhich could have caused you to lose control during ordinary and predictable driving conditions ”.
If the court agrees to the family of one of the two victims, Tesla could be forced to pay compensation of approximately $ 60,000. The NHTSA is still investigating the accident, which last November had updated the dynamics by explaining that the electric was accelerating before crashing into a tree and subsequently catching fire, compromising the lives of the two occupants of the car.
