Body said it cannot analyze representation before candidacy registration
The Regional Electoral Prosecutor’s Office of Paraná filed a petition asking for the ineligibility of the former coordinator of the Lava Jato operation task force in Paraná, Deltan Dallagnol (Podemos-PR). He is a candidate for federal deputy.

“It is only at the time of formalizing the application for registration of candidacy that the eligibility conditions and causes of ineligibility must be assessed”said the Regional Electoral Attorney Mônica Dorotéa Bora.
“Despite having announced his intention to run for the post of Federal Deputy in the upcoming elections, the reported pre-candidate, so far, has not been chosen at a party convention to participate in the election, nor has he made a request for registration of candidacy”he said. “Even because the initial term of the time lapse reserved for party conventions and the RRC protocol has not even elapsed [requerimento de registro de candidatura].”
Parties, federations and coalitions have until August 15 to apply for candidacy registration.
The decision to file the representation did not analyze the merits of the request. The prosecutor said that the MPE (Public Electoral Ministry) will analyze “strictly” the eligibility conditions of all candidates, after the formalization of applications.
The representation was presented by businesswoman Roberta Luchsinger (PSB), pre-candidate for federal deputy for São Paulo. She argued that when Dallagnol resigned from the MPF (Federal Public Ministry) in November 2021, he was responding to proceedings at the CNMP (National Council of the Public Ministry).
“The Law of Ineligibility LC 64/90 provides, in summary, for the prohibition that magistrates and members of the public prosecutor who have requested exoneration while pending an administrative disciplinary process can contest elections held in the eight years following said request”he said.
In the request, Luchsinger stated that he called the Electoral Attorney’s Office to report the fact of the possible ineligibility, “considering that there is still no open deadline for the notice of ineligibility that can be promoted by any citizen”.
Said he filed the petition “so that there is sufficient time for the collection of evidence in order to instruct the demand in due season”.

The businesswoman was responsible for submitting a request for an investigation into the transfer of former minister Sergio Moro’s electoral domicile from Paraná to São Paulo.
The MP-SP (Public Ministry of São Paulo) determined that the PF (Federal Police) investigate whether Moro committed a crime by transferring the electoral domicile without having a fixed residence in the state. On June 7, the TRE-SP (Regional Electoral Court of São Paulo) annulled the transfer, and prevented Moro from running for São Paulo. The decision was made in a lawsuit filed by the PT.
In a note, Dallagnol stated that it is expected that “members of the old politics and their allies” oppose your pre-candidacy.
“However, there is no chance that the challenge to my candidacy will succeed because my situation as Deltan Dallagnol is far from any provision of the ineligibility law”he said.
“It backfired, because those who support me and want Lava Jato in Congress have intensified their support in the face of the attacks”declared. “I have received messages of support from many people because these attacks are attacks on a cause that all good Brazilians want to see represented in Parliament. Lava Jato ended with 80% support in society, a rare rate of support that comes close to unanimity.”
