The former attorney Jesus Murillo Karam received a favorable decision from the control judge of the Federal Criminal Justice Center of the Reclusorio Sur, Juan José Hernández Leyvawho granted him the precautionary measure of house arresta measure that was rejected by the Commission for Truth and Access to Justice in the Ayotzinapa case.
The First Collegiate Criminal Court granted the protection considering Murillo Karam's advanced age, which is over 75 years old, and his state of health, affected by diseases such as COPD, systemic arterial hypertension and cerebral vascular insufficiency.
However, the CoVAJ has expressed its deep condemnation of the determination of the control judge of the Federal Criminal Justice Center in Mexico City, Juan José Hernández Leyva, who granted the precautionary measure of house arrest to the former attorney general of the Republic.
This decision represents a blow to the right to truth and justice of the victims and their families, the organization warned.
The former official has been identified as one of the main people responsible for obstructing justice in the case of the disappearance of the 43 students from the “Raúl Isidro Burgos” Normal Rural School in Ayotzinapa, as well as for constructing the questioned “historical truth” about what happened. in Iguala in 2014.
Faced with this situation, CoVAJ indicated that it has reiterated its commitment to working together with the mothers and fathers of the missing students on three main fronts:
First of all, it seeks to strengthen search efforts on the ground, in collaboration with the Special Investigation and Litigation Unit for the Ayotzinapa Case (Ueilca) of the Attorney General's Office (FGR), the National Search Commission (CNB) and the relevant federal and state authorities.
Secondly, work continues to break the pact of silence surrounding this case and obtain crucial information that could lead to the whereabouts of the missing young people.
Finally, he noted that legal actions will be intensified to ensure that those responsible for these heinous crimes are brought to justice and the full weight of the law is applied to them, in an effort to close this painful wound in Mexico's history.
House arrest
On April 4, the First Collegiate Criminal Court of the First Circuit ruled in favor of the former attorney in his request for house arrest, in response to an amparo lawsuit filed by himself.
Faced with this reality, the control judge has established the necessary measures to guarantee compliance with the measure of justified preventive house arrest for the accused.
In a hearing in which the corresponding restrictions were established, the judge imposed seven precautionary measures on the former federal official.
Among these measures is permanent surveillance by the National Guard or the FGR on the perimeter and access to his residence in Las Lomas de Chapultepec, as well as a strict registry of people who visit his home.
In addition, he is prohibited from any communication with the victims or witnesses of the case for which he is being tried, and he must hand over his passport and visa if he has them. The judge also ordered the issuance of an immigration alert to prevent his departure from the country.
Despite the request of the Public Ministry of the Federation to impose 15 precautionary measures, the judge determined that only house arrest was appropriate, without ruling on the risk of escape argued by the Attorney General's Office of the Republic.
After the hearing, Murillo Karam was transferred to the Tepepan Penitentiary Hospital to carry out medical procedures. He is expected to be taken to his home in Lomas de Chapultepec before 3:00 p.m. on Saturday, April 13.
