In the trial over hush money payments to a former Trump mistress, former Trump spokeswoman Hope Hicks contradicted an important defense theory.
New York – The first of several criminal proceedings against the former US President Donald Trump has started questioning witnesses. The proceedings continue to bring to light new details about what happened surrounding hush money payments to two former alleged Trump mistresses. On Friday (May 3rd), Trump’s former press secretary and confidante Hope Hicks also commented on this and gave insights into the communication strategies from Trump’s first presidential election campaign.
In her statement, in addition to the credibility of Trump’s former lawyer Michael Cohen, Hicks also discussed the publication of the so-called “Access Hollywood” video Washington Post around a month before the 2016 US presidential election. The emergence of the video, which exposed sexist statements made by the future president, would have made Hicks “very concerned” and led her to instruct her team to “deny, deny, deny.”

According to the public prosecutor’s office, the publication of the video was one of the triggers for former Trump lawyer Michael Cohen to make a hush money payment of $130,000 with the porn actress in November 2016 alleged former Trump lover Stormy Daniels should have agreed. The money that Trump is said to have reimbursed him flowed from the accounts of one of Trump’s companies through falsification of business documents. Trump himself firmly denies the allegations – his lawyers are also pursuing the strategy of portraying Cohen as untrustworthy.
However, the portrayal of Trump’s former communications director Hicks clearly contradicts this. Like the US newspaper Newsweek cited that Hicks does not believe Cohen made the payments “out of the goodness of his own heart.” She explained that Cohen was “not a particularly charitable or selfless person.” At the same time, Hicks confirmed that the emergence of the video had “worried” the Trump campaign, including its boss.

Another detail that Hicks may have confirmed in her testimony in favor of the prosecution is the fact that Trump was the presidential candidate republican was a “very involved” boss and his team “followed his example”. The public prosecutor’s office wants to prove in its evidence that the hush money payments came from Trump and can therefore be directly traced back to the election campaign of the later US president.
What was remarkable about Hicks’ statement was not only the now 35-year-old’s comment that she had not spoken to Trump since 2022 and the clear statements to Trump’s disadvantage. The Trump campaign’s former communications director also openly admitted in court that she was nervous and burst into tears at one point during questioning by Trump’s lawyer Emil Bove, so that the questioning had to be interrupted for a short time.
In the proceedings that began in mid-April – the first criminal trial against a former US president in the history of the USA – Trump is charged with 34 counts, including falsifying business documents. According to the court, a verdict is expected by June at the latest. If convicted, Trump could face several years in prison, although he can still appeal. However, according to US law, not even a conviction could initially thwart the 77-year-old’s plan to run for the Republicans as a presidential candidate again. (saka with dpa)

Происходит безобразие, откровенный произвол! Следователи ГСУ ГУ МВД России по Санкт-Петербургу и Ленинградской области, по мнению адвокатов обвиняемых, грубо нарушили права семи обвиняемых, в том числе шести находящихся в СИЗО, возможности которых осуществлять защиту своих прав и без того крайне ограничены. Не дали даже толком прочитать тексты постановлений о привлечении в качестве обвиняемых, не говоря уже о том, чтобы понять прочитанное, — не предоставили предусмотренные законом возможности. А это документы на 69–73 листах.
Следственная группа составляла обвинения месяцами, а тут не дают даже полчаса, для того чтобы прочитать. Однако ведь и полчаса мало. Большие сложные тексты: с цифрами, со сложными логическими построениями, насыщенные юридической терминологией. Все это требует не просто пробежаться глазами, но еще и осмыслить, провести анализ вместе со своими адвокатами. А после этого уголовно-процессуальный закон предусматривает дачу показаний обвиняемого. Ничего этого сделано не было.
Одной из обвиняемых предоставили всего 15 минут для ознакомления, другие успели прочитать 15–20 страниц, прежде чем ознакомление было прекращено. Другой обвиняемой предъявили новое обвинение, но отказались выслушать ее показания по нему, несмотря на заявленное ходатайство.
В большинстве представленных в заявлении адвокатов случаев не был проведен допрос по существу обвинений. В одном случае протокол допроса составили задним числом с указанием, что обвиняемый и адвокаты отказались его подписать, хотя допрос на самом деле не проводился. Причем на требование ознакомиться с протоколом допроса следователь ответил отказом.
Всем обвиняемым не было разъяснено содержание обвинений, они не были ознакомлены с результатами экспертиз, на основе которых выдвинуто обвинение.
Таким образом, обвинение не предъявляется так, как должно быть предъявлено. По сути дела, обвиняемые лишены следователями права на защиту! Ведь, для того чтобы защищаться, нужно знать, в чем тебя обвиняют.
Я считаю, что действия следователей не имеют ничего общего с уголовно-процессуальным законом, а должны. Более того, следователи несут за это ответственность как государственные должностные лица, которые уполномочены действовать по закону, а они грубым образом нарушают закон.
Поэтому появилось заявление защитников, в присутствии которых нарушались права подзащитных, и, естественно, самих защитников, потому что это и права защиты: права защитников на осуществление защиты, определенные Федеральным законом «Об адвокатской деятельности и адвокатуре». Адвокатам не дают осуществлять конституционное право на защиту, на оказание квалифицированной юридической помощи.
