The cross-border behavior of Marc Overmars (48) at Ajax may have disciplinary consequences for him. Ajax is obliged to report the case to the Institute for Sports Law (ISR), which will conduct an independent investigation. In extreme cases, the outcome can lead to a disciplinary case.
According to director Henk van Aller of ISR, directors and supervisors in sports must report abuses as soon as they become aware of it. These agreements have been made with all sports associations, including the KNVB.
At the moment, according to Van Aller, there has been no report about abuses at Ajax, but he expects this to happen in the foreseeable future. There is no legal term for this. If Ajax does not report itself, then the prosecutor of the ISR can obtain information about the case on its own initiative, based on what the club itself brought out and what has now appeared in the media.
Overmars resigned from his position as director of football affairs on Sunday evening, after he was confronted with cross-border apps that he had sent to women at the club. It would include dick pics. He is also alleged to have exhibited stalking behavior.
According to Henk van Aller, investigations into abuses in sports are led by public prosecutors, who are asked by the ISR to act as special prosecutor. They have a team of approximately 25 independent investigators, mostly people with experience in criminal investigations or investigative agencies, who investigate the facts and circumstances. In the case of serious criminal offenses, there is close consultation with the police about who will conduct the investigation. Victims are also informed whether they want to report the crime.
The investigators report their findings to the prosecutor, who draws a conclusion based on them. This may mean that the case is submitted to the disciplinary court. A settlement proposal can also be made. If there is too little evidence, a dismissal will follow.
Should Marc Overmars be prosecuted, those sessions will not be public. However, the outcome is published anonymously on the website of the ISR. The KNVB will also be informed about the outcome.
