He Government of the president of the United States, Joe Bidenpromulgated this Thursday a new rule that seeks to raise the standards under which asylum can be requested in the southern border.

The rule, which will go into a review phase before taking effect, will instruct immigration agents to prohibit people considered a “risk to public or national security” can submit an application for asylum and therefore be admitted into the country.
What changes?
These filters are already applied when studying asylum cases, but with this new measure the Executive allows them to be used during the interview phase of “credible fear”, where it is decided whether or not a person meets the requirements to request protection after crossing the border with Mexico.
Who will be affected by this measure?
The Joe Biden Administration estimates that these new standards will only affect a small number of people.
Specifically, those who have a serious criminal history or who are linked to criminal activity. “And that’s just a small percentage of all the people” who are detained each day at the southern border, a senior official said during a call with reporters.
People who are denied the opportunity to request asylum are expelled to Mexico immediately or enter a formal deportation process, depending on their nationality.
In what context is this new measure given?
It is not the first time that the White House has announced changes to asylum regulations in an attempt to limit the arrival of people at the southern border.
Just a year ago, the Democratic Government introduced a series of changes that classify migrants who cross the border irregularly and who have not requested protection in a third country during their journey to the United States as “not eligible” to apply for asylum.
How are the arrest figures going?
The global context of a historic increase in the number of displaced people on the continent, together with pressure from the opposition and the moderate wing of his party, has led Biden to abandon his campaign promises to “restore” the system of asylum.
On the contrary, the Democratic Administration maintained during the first years restrictive policies inherited from the previous Government, such as the so-called Title 42, which allowed hot returns, and then expanded or replaced them with new rules that seek to limit the number of people who can request asylum on the southern border.
As a counterpart, the White House has promoted “humanitarian legal pathways” programs for people of some nationalities (Cuba, Haiti, Nicaragua and Venezuela), which have allowed more than 400,000 people to enter the United States.
