The Working Committee of the Chamber of Deputies approved a proposal that gives women in situations of domestic and family violence priority to enroll in training and capacity building courses provided by national learning services, as well as through Sebrae (Brazilian Support Service for Micro and Small Businesses).
The measure will apply to women registered, at the request of a judge or police authority, in the register of assistance programs of the federal, state and municipal governments. The Public Defender’s Office or the Public Prosecutor’s Office may also ask the judge or police authority to refer victims to courses, which will be free of charge.
The measure covers:
- Senai (National Industrial Learning Service);
- Senac (National Commercial Learning Service);
- o Senar (National Rural Learning Service);
- Senat (National Transport Learning Service); It is
- o Sescoop (National Cooperative Learning Service).
The approved text is the substitute of the rapporteur, deputy Daniel Almeida (PC of B-BA), to the PL (bill) 10018 of 18already approved by the Senate, and more than 20 attached. The measure will be inserted into the Maria da Penha Law.
According to the rapporteur, “providing women with conditions to maintain their livelihood and possible children constitutes an important affirmative policy for removing women from the situation of male economic dependence”.
The original project, by former senator Ataídes Oliveira, reserves at least 5% of places on training and qualification courses in national learning services and at Sebrae for women in situations of domestic and family violence.
But the rapporteur chose not to maintain the reservation of vacancies, and to only prioritize vacancies for these women.
Shares in companies
In the substitute, rapporteur Daniel Almeida also incorporated several measures provided for in the attached projects.
Among them, the prediction that in companies providing services with 100 or more employees, at least 5% of vacancies will be reserved, preferably, for women in favor of whom a protective measure has been granted or for women in a situation of temporary social vulnerability.
“It is worth noting that the proposal provides that vacancies will be reserved preferentially for these women, that is, if there are no women in such a situation in the company’s region, they will be exempt from fulfilling the obligation”said the rapporteur.
“Therefore, this quota is distinguished from the hiring of people with disabilities, which is mandatory and subjects the employer to payment of a fine for non-compliance”he stated.
Outsourcing contracts
The approved text also changes the Bidding and Administrative Contracts Law to establish, in outsourcing contracts, the reservation of at least 8% of the workforce responsible for executing the contract for women in situations of domestic or family violence.
The measure will apply to contracts with a minimum number of 25 employees.
According to the substitute, failure to comply with this rule will lead to contractual termination, unless the contracted company proves that there is no minimum number of women with the necessary qualifications in the location where the services will be provided.
“This is not new, as the decree 11,430 of 23 already provides for a minimum percentage of 8% of vacancies allocated to women victims of domestic violence in labor outsourcing contracts in the public service”said the rapporteur.
The current Bidding Law only states that the notice may require a minimum percentage of women victims of domestic violence to execute the contract.
Women Friendly Company Seal
The rapporteur also proposes changes to the law 14,682 of 23which created the Women-Friendly Company Seal.
The substitute establishes that the company certified with the seal will be able to deduct from Income Tax the equivalent of a minimum wage per month of effective work for each hired employee. The total deductions cannot exceed the joint limit of 4% of Income Tax due.
“In this way, in addition to focusing the fiscal stimulus on hiring low-income women, we allow more jobs to be created using the same proposed revenue waiver limit (4% of IRPJ due)”said Daniel Almeida.
Sine
Finally, the approved text changes the law 13,667 of 18, which created Sine (National Employment System), to establish an order of priority for assistance to women in situations of domestic and family violence. Today, the law already gives them priority in service through Sine and reserves 10% of the vacancies offered for intermediation.
Under the substitute, the order of priority will be women who suffer domestic violence and who are unemployed, followed by women who have a job but, due to a proven threat, need to change their residence.
Next steps
The project will be analyzed in conclusive character by the commissions for the Defense of Women’s Rights; Finance and Taxation; and CCJ (Constitution and Justice and Citizenship).
