The head of the Court of Instruction number 21 of València has inadmitted to process a complaint for the infiltration of a National Police agent in social and neighborhood movements of the Benimaclet neighborhood. The car, to which eldiario.es has had access, distinguishes the figure of the infiltrated agent of the undercover police. In the first case, in which the police are framed, the infiltrates “are intended to integrate into radical and violent social groups to achieve relevant information and avoid, in this way, that there are illicit and disturbance altercations in public life.”
The magistrate frames the role of the infiltrate in the “police investigation technique aimed at the prevention and punishment of the crime of which all security services make use.” The aforementioned police technique are part of the “deception” and the “use of an alleged identity to guarantee the necessary confidence for obtaining information”, as recognized by the resolution.
The magistrate does not see indications of the alleged crimes of torture and attack on moral integrity and intimacy denoucated by complainants, represented by the entity alert solidària. “At no time can the intention of the intention of producing a physical or mental suffering of the complainants be charged,” says the car.
The judge emphasizes that the psychic or psychological damage suffered by the complainants “appears more than a year after having maintained the last contact with the complaint.” The psychological impact is framed by the magistrate in the fact of “having discovered her police status, feeling deceived.”
Under the covert identity of Ramón Martínez Hernández, the Topo landed in March 2020 in Benimaclet, which concentrates much of Valencia’s social and student activism. For two years, the agent spied on neighborhood and social groups in the neighborhood that maintain a public activity, also on social networks.
The complainants argued that the alleged crimes of torture and attack against moral integrity and intimacy would have occurred. Two of the complainants claimed that they had suffered psychological injuries after the agent infiltration had uncovered.
The judge covers in the resolution of July 25 of the Provincial Court of Barcelona that ratified the inadmissibility of a complaint for the infiltration of another National Police agent in independence movements of the city.
Solidària alert resource
The lawyer of the complainant has presented this Friday an appeal for reform before the judicial resolution. The resource argues that the refusal to “minimal” proceedings “frustrate any possibility of knowing the true legal figure of the infiltrated police and if it had the relevant legal authorization,” as reported alert Solidària in a statement.
Alert Solidària regrets that the judge “does not list what the facts are” or the radical or violent character of the spied groups, such as Cuidem Benimaclet, the Social Center L’Horta or the coordinator between Barris.
