A Brazilian federal court has issued an urgent investigation order against an Israeli soldier who is on vacation in the South American country for a possible crime of genocide and crimes against humanity.
The Hind Rajab Foundation (FHR), promoter of the complaint, has highlighted that the court order It is a “historical legal fact” that has the support of the Prosecutor’s Office and that it represents “a crucial step towards accountability for the crimes committed in Gaza.”
Mass demolitions of civilian homes in Gaza
The foundation assures that the suspect has participated in “massive demolitions of civilian homes in Gaza” during the “systematic campaign of destruction” by Israeli forces. “These acts are part of a broader campaign to impose unbearable living conditions on Palestinian civilians, constituting genocide and crimes against humanity under International Law,” the group argued.
The complaint includes video recordingsgeolocation data and photographs that show the accused placing explosives and participating in the destruction “of entire neighborhoods” that would demonstrate the direct involvement of the person under investigation, whose name has not been revealed.
“This is not a distant order. This individual has contributed to the destruction of houses and his own statements and behavior clearly align with the genocidal objectives in Gaza,” FHR’s chief lawyer, Maira Pinheiro, argued in a statement.
Families whose homes were destroyed have joined the cause. “Complainants fight for justice through legal channels. They must be held accountable and restore the dignity of people whose lives have been destroyed,” said the president of the FHR, Dyab Abu Yahyá. The group had requested the immediate arrest of the suspect due to the risk of flight and to avoid the destruction of evidence.
Abu Yahya He stressed that this is a “historic moment” and a “powerful precedent” for other countries to act on war crimes.
Case in Chile
Meanwhile, in Chile, the same foundation has filed a complaint with the authorities due to the presence in the country of an Israeli soldier, Saar Hirshoren, accused of crimes against humanity, as indicated by the Foundation’s legal advisor, Hugo Gutiérrez.
The NGO assures having located Hirshoren in southern Chile, specifically in Aysén, and maintains that he is a member of the Combat Engineering Battalion of the Israeli Defense Forces involved in crimes committed in Gaza. Specifically, the man was located in the Aysén Region.
Hirshoren would be directly related to the commission of genocidecrimes against humanity and war crimes, so, according to the regulations signed by Chile, it would be appropriate for him to be tried and punished for said acts.
“Hirshoren posted on his Instagram account a video that shows him with other individuals in Gazaon active duty, while committing war crimes and crimes against humanity,” Gutiérrez said.
“The 749th Combat Engineering Battalion, known for its extreme cruelty, has participated in the systematic destruction of civil infrastructure in Gaza, such as demolition of residential buildings, places of cultural interest and essential facilities, actions that violate international humanitarian law,” highlights the Foundation.
It is also noted that “the battalion’s deputy commander, Lieutenant Colonel Adi Bekore, publicly stated that Their mission was to “destroy Gaza”, indicating a deliberate strategy directed against civilian structures.”
The document highlights that “the application of the principle of extraterritorial justice allows national courts to intervene in cases where the perpetrator of the crimes is within Chilean territory or there are jurisdictional links that enable criminal action, reaffirming the State’s obligation to pursue and punish the most atrocious international crimes.”
