An 81-year-old man was sent to prison for the murder of Nelson David Ramírez, a 35-year-old Honduranwho would have entered the home illegally to steal the elderly adult's belongings.
The popular jury of Spain found José Manuel Lomas, 81, guilty of the crime of homicide with possible intent, who shot the 35-year-old man twice with a shotgun.
The events occurred in 2021 after Nelson David Ramírez accessed the house located in the Parque Forestal de La Atalaya in Ciudad Real, to steal tools.
“I do not abandon my house and I defend it. I don't know how I will defend her, but I don't run away, I prefer to die defending my house rather than run away and leave it in the hands of criminals,” José Manuel Lomas told the jury.
In addition to this, the older adult added: “I am not leaving my house, it is what we humans achieve after a long life of struggle, sacrifice, effort and passions. Have a place where you feel protected because it is yours, and according to the Constitution, because it is inviolable”.
According to ABC, Nelson David Ramírez had 36 records in the National Police and nine in the Civil Guard.
Initially, a 12-year sentence had been requested for Lomas, alleging that he suffers from an “anomaly” or “psychological alteration” that causes a reduction in the sentence. Although the examination did not give a positive answer, the reduction in sentence did occur.
With seven votes in favor and two against, the 81-year-old man was sentenced to seven and a half years in prison for this homicide.
“They could sentence him to 2.5 years and, since he has already served nine months, he may not even enter. The sentence could be suspended. We understand that it is a success, since they requested 25 years, but even so we are not satisfied with the jury's decision and we will appeal it,” said lawyer Juan Manuel Lumbreras.
