A very widespread practice when a loved one dies is to dump the ashes somewhere with a symbolic meaning like the sea, but is it legal? Many doubts arise as to whether the remains of an incinerated deceased may be deposited in any space.
This is an image that you have been able to see a thousand times on the screen. To fulfill the last will of the deceased, the relatives embark on a journey to that point that has a close relationship with the deceased. The sea, the beach, a cliff, a forest are the most used environments to throw the ashes. They are open spaces that allow you to say goodbye to that partner, child, or friend. Each country has different regulations. However, in Spain it is forbidden to spread the ashes in the sea. Although, as explained from the Mapfre insurance company, there are two possibilities to satisfy this desire if it is carried out through a funeral home that has that permit. The other option, which is more complicated, consists of having a specific authorization in a particular way from the General Directorate of the Merchant Marine (DGMM) through the Ministry of Development or the autonomous community.
In case of obtaining the permit or doing it through a funeral company, the regulations require that they be deposited with a biodegradable container that is approved. If the remains of ash are thrown without any permission and in addition, with the urn it is a fine of up to 750 euros. Why is it forbidden? The regulation is governed by an environmental issue.
As for throwing the ashes in natural spaces such as a field or forest, there is no regulation at the state level, but some municipalities have ordinances that may prohibit or allow it. Even so, a biodegradable urn is necessary since otherwise it can lead to a crime against the environment. The other option that does not involve removing the remains is to keep the ashes inside the urn in a columbarium or cemetery niche.
