Vaccino Scanzi, the prosecutor asks for the case to be closed but Codacons is opposed
It was March 2021 when the reporter Andrea Scanzi he ended up in the spotlight of the media (and the insults of the network) for having vaccinated “skipping the line” with the first dose of Astrazeneca at the vaccination hub of the Centro Affari e Fiere in Arezzo. Tomorrow, December 3, the showdown is expected before the gup of Arezzo Giulia Soldini: the hearing will decide the future of the investigation launched into the vaccination case of Andrea Scanzi. The deputy prosecutor Marco Dioni presented a request for dismissal, which was opposed by the Codacons, offended party in the proceedings.
In particular, the power of attorney, although recognizing that at the time when the administration took place Scanzi did not fall into any vaccine category and therefore did not have the right to anticipate the first dose, he believes that from a juridical-legal point of view no crime can be configured, ” since these are negligent facts and there is no violation of the law, but only guidelines or recommendations ”.
“Based on the guidelines and recommendations – reads the request of the prosecutor – actually Scanzi had no right to be vaccinated (not falling into any of the categories indicated in the guidelines) ”, but, it is emphasized, ” at that moment the situation was particularly confused, given that the Astrazeneca vaccination had been temporarily suspended, that the vaccination campaign was struggling to take off and that shortly before, the special commissioner had publicly said that every single dose had to be wasted and whoever was available should be vaccinated ”.
The absence of a crime is also evident, according to the reconstruction of the prosecutor’s office, from the fact that Evaristo Giglio, the doctor of the Usl of Arezzo who took care of finding the place for vaccination in Scanzi on 19 March 2021, ” both in the internal investigation and in the fact-finding investigation of the Public Prosecutor’s Office, claimed to have made a mistake believing that Scanzi really belonged to the category of ‘caregivers’ (in this regard he exhibited a certificate 104 against a subject who has the same name with Scanzi’s mother, demonstrating the fact that he had made a mistake) ”.
To similar conclusion, the prosecutor arrived for the doctors who decided to administer the vaccine to Scanzi and who were heard as people informed on the facts during the investigation: no criminal offenses were identified for them either. Hence the request for filing the case.
